Terms of Service
1. Who we are
Emberwell (the “Service”) is provided by Eul Studio LLC, a Wyoming limited liability company, 30 N Gould St, Ste R, Sheridan, WY 82801, USA (“Eul Studio LLC”, “we”, “us”). These Terms of Service (“Terms”) are a binding agreement between you and Eul Studio LLC. Contact: support@getemberwell.app.
2. Accepting these Terms
By downloading, accessing or using the Service, or by making a purchase, you agree to these Terms, our Privacy Policy, our Refund Policy and our Subscription Terms. If you do not agree, do not use the Service. You must be at least 18 years old, or the age of digital consent where you live if it is higher, to use the Service.
3. The Service
Emberwell is a warm, modern daily faith habit for Christians: a short devotional and prayer each day, arranged into a personal plan built from a few questions about you. We may change, improve, suspend or discontinue features of the Service at any time. If we discontinue a paid feature you are subscribed to, we will tell you in advance or refund the unused part of your subscription.
Emberwell offers devotional content for personal reflection. It is not a substitute for pastoral, medical or mental-health care. Bible quotations are from the World English Bible (public domain).
4. Your account
Some features need an account. Keep your sign-in credentials secure and tell us promptly about any unauthorised use. You are responsible for activity under your account. You can delete your account at any time: In the app: Settings → Delete account, or email us from the address on your account. Deleting your account erases your account, journal and progress. It does not cancel a Google Play or App Store subscription; cancel that in the store.
5. Subscriptions, payments and trials
Paid features are sold as auto-renewing subscriptions. The price, billing period, any free-trial length and the renewal terms are shown to you before you confirm a purchase, and the price shown at checkout is the price that applies. Taxes may apply. - Google Play. Purchases made in the Android app are processed by Google and are also subject to Google Play’s terms.
- App Store. Purchases made in the iOS app are processed by Apple and are also subject to Apple’s Media Services Terms.
- Web. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our web orders. Paddle provides all customer service inquiries and handles returns for those orders, and the Paddle Buyer Terms apply to them.
Refunds are covered by our Refund Policy. Nothing in these Terms limits any right to a refund or withdrawal that the law where you live gives you.
6. Acceptable use
You agree not to misuse the Service: no breaking the law, infringing others’ rights, harassing others, uploading malicious code, attempting to access systems or data you are not authorised to access, scraping or reverse-engineering the Service except where the law allows it, or reselling access to it.
7. Content and intellectual property
The Service, its content, design, software and trademarks belong to Eul Studio LLC or its licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial purposes under these Terms. Content you create in the Service remains yours. You give us a licence to store, process and display it only as needed to provide the Service to you.
8. Disclaimers
The Service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free.
9. Limitation of liability
To the extent the law allows, Eul Studio LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim. Some jurisdictions do not allow these limitations, so they may not apply to you, and nothing here limits liability that cannot be limited by law.
10. Termination
You may stop using the Service at any time. We may suspend or end your access if you seriously or repeatedly breach these Terms. If we end your access without cause, we will refund the unused part of any prepaid subscription. Sections 7–11 survive termination.
11. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state and federal courts located in Wyoming. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in its courts.
12. Changes to these Terms
We may update these Terms. If a change is material, we will notify you in the Service or by email before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.
